The divorce papers have been filed but procedures might stall because they don’t have a prenup, which means that, under California law, everything should be split in 2.
As Radar Online puts it, this means we’re in for a drawn-out divorce battle that’s threatening to turn nasty because she is worth much more money than him, and his attorney will try to get her to give him half.

In theory at least, no one marries thinking of the day when they will be filing for divorce, because marriage is a “till death do us part” kind of thing. Celebrities have learned the hard way that love is less likely to last when money meets fame, so they get prenups now, to make sure both parties leave with what they came in, should the divorce day arrive.
When Gavin and Gwen tied the knot 13 years ago, the divorce rate wasn’t as high as it is today and, at the same time, they were positive theirs was a union made to last. So when Gavin and her own people advised her to get a prenup, she scoffed at it, insiders reveal for the celebrity publication.
She is probably very sorry she did that, because she’s worth a reported $120 million (€109.5 million), while Gavin’s estate is estimated at “just” $20 million (€18.2 million). For the record, initial reports claimed she was worth less and he more.
Either way, because they don’t have the prenuptial agreement in place, they have to throw in everything they have and then split it in 2. You can see why Gwen would think that’s an unfair arrangement for her, because she would have to part with half her fortune.
Gwen is trying to buy Gavin off
To make matters even worse, the report adds, the marriage ended because of something he did and yet, here she is, about to pay for it.
Despite his repeated denials, she is convinced that he cheated on her with their children’s nanny, so the last thing she wants right now is to have him walk away from the marriage with half her money.
“Gwen has really struggled with the idea of just handing over half of her hard-earned money to Gavin, and there is a lot of anger there,” an insider says. “Gwen is hoping to just pay Gavin off because she doesn’t want to pay him any type of support. Gwen’s approach is that she should get to keep what is hers.”
Obviously, Gavin and his attorney, disso-queen Laura Wasser, don’t exactly see things in the same light. As per the same report, Wasser has vowed to get as much money from Gwen as legally possible, and she’s not the kind of attorney to make this type of promises if she knows she can’t deliver.
