Everyone who heard that Lindsay Lohan claimed she had a miscarriage was pretty sure that it was just something that she made up as an excuse on her show to boost poor ratings, as well as get some of the heat off her back because she didn't show up for filming for two weeks.

Also, she didn't really ever mention her miscarriage again since she came out on her reality series feeling sorry for herself. That's why most of the press and the audience didn't put much weight on her account.

Today, we find out from TMZ that Lindsay is still sticking to her story and using the miscarriage argument in court, where she is currently trying to win a case over her clothing line, 6126. The first round of the lawsuit has already been lost, since Lohan failed to respond to the allegations in time.

Now she's trying to make a comeback and she's using her miscarriage argument in a sworn testimony. Lindsay is saying that the main reason for which she was unable to respond to the lawsuit is that “I have been overwhelmed since leaving rehab and dealing with my sobriety and a miscarriage.”

This adds a whole new angle to the story, since going on the record in a sworn declaration has legal implications. Some of you might know this but, if you're caught lying in court, you can be charged with perjury and that is punishable with jail. Of course, for Lindsay it wouldn't be the first time she saw the inside of a jail cell.

The lawsuit in question is worth $5 million (€3.6 million), which is more than enough an incentive for the actress who has been struggling to bring in more cash lately, due to the fact that her career is pretty much over. Her unreliability and scandalous nature are deterring many in the industry from working with her and that's why Lindsay can't afford to lose this trial.

If you recall, Lindsay said on her reality show season finale that she had suffered a miscarriage at some point, which left her unable to move or film: “No one knows this – I had a miscarriage for those two weeks that I took off. It's a really long story, but that's why on the show when it says she doesn't want to come down, she doesn't want to come down, I couldn't move. I was sick. And mentally that messes with you.”
