Apple tried to convince the court that Samsung's misconduct netted it an automatic win

Naturally, Apple tried to milk Samsung's decision to publish rejected evidence for more than it was worth, but it was denied the easy win.

For those that need a reminder, Samsung and Apple are holding the jury trial in the Californian District Court.

The former recently drew Judge Lucy Koh's ire by publishing a document it was forbidden from using as evidence.

More recently, Samsung's lawyer defended the move and accused Apple of damaging his personal reputation.

Basically, the two companies are causing as much drama as possible.

Apple seems to be doing it more avidly though. It even requested a total win on the grounds that Samsung's alleged misconduct "merits a severe penalty that will establish that Samsung is not above the law."

The judge rejected this motion, so the case will resume on Friday.
