The copyright infringement lawsuit continues

American Airlines sued Google for copyright infringement some time ago and even if the Mountain View company requested the judge to dismiss the complaint, the court today announced that the case will go forward. Correct me if I'm wrong, but I think the case was started a few months ago when American Airlines first accused Google for selling its name through the company's advertising platform. Being the most popular search engine on the web, Google sends adverts which are displayed on the SERP once a user enters a certain keyword. American Airlines sustains Google doesn't have the right to sell its name and brought a lawsuit against the Mountain View company.

After the judge received the complaint, Google filed a motion to require the court to dismiss the lawsuit which was finally denied today.

"We are pleased by the judge's order denying Google's motion to dismiss our claims. American would not have brought its lawsuit against Google if we did not believe in the merits of our claims, and the court's order ... ensures that we will have an opportunity to develop and pursue those claims," said American Airlines spokesman Tim Wagner in a statement according to PC World.

Google sustained it didn't expect to see its motion rejected by the court and pointed to the advertising platform's trademark policy which provides information for both advertiser and trademark owners. In fact, Google has been working on its policies for a long time because they are the subjects of numerous lawsuits brought by other companies against the search engine developer.

"While we were disappointed that the court denied our motion to dismiss we believe that the American Airlines trademark suit lacks merit. Google's trademark policy strikes a proper balance between trademark owners' interests and consumer choice and has been validated by prior court decisions," a Google representative said according to the same source.
