This should set tongues wagging again about a supposed alcohol problem: last night, Christina Aguilera and boyfriend Matt Rutler were arrested after officers noticed he was driving erratically. Both were booked, but the singer will not be prosecuted.

TMZ broke the news that the couple had been partying at a fancy restaurant well past midnight, after which they got in their car to go home. Matt was behind the wheel.

Rutler was driving “erratically” and, when police officers pulled him over, they noticed he was intoxicated, albeit only one point above the legal limit.

Christina, on the other hand, was so severely intoxicated officers deemed she could not take proper care of herself – so they drove both of them downtown, where they were booked and had their mugshots taken.

“Cops say Aguilera was a passenger in a car driven by Matthew Rutler when officers noticed he was driving erratically around 2:45 AM, so they pulled the vehicle over,” TMZ reports.

“Officers determined Rutler was drunk and arrested him for misdemeanor DUI. Cops say the deputies determined Aguilera was also ‘extremely intoxicated ... and since she was unable to care for herself, Aguilera was taken into custody,” notes the same report.

Bail for Rutler was set at 5,000 and he will be charged with a DUI. Aguilera, though, will not be prosecuted because she was “not involved in any criminal activity,” a police spokesperson says for the aforementioned media outlet.

She did, however, spend a few hours in a cell, until she was deemed ok enough to walk out on her own two feet. Rutler was released afterwards.

“[LA County Sheriff’s spokesman Steve] Whitmore confirms Christina was arrested, booked, fingerprinted, put in a cell, and then monitored. But... Whitmore insisted they have ‘no desire’ to prosecute her,” TMZ also reports.

Because she will not be prosecuted, Christina’s mugshot will not be released to the public, the same spokesperson reveals.

This, of course, is not to say that it will not get out online because it already has – E! News has this snap of the booking sheet, complete with Aguilera’s mugshot.
