Sega and Gearbox have commented on the class action lawsuit that's just been set up by a bunch of angry Aliens: Colonial Marines buyers, saying that the whole trial is frivolous.

Aliens: Colonial Marines was at the center of a massive controversy back in February as the final game wasn't similar to the more polished versions that had been demonstrated through videos, hands-on sessions, and other such promotional efforts.

As a result, some customers have decided to form a class action lawsuit against publisher Sega and developer Gearbox Software.

According to Sega, who talked with Kotaku, the lawsuit is "without merit."

Gearbox has also chimed in and revealed that the lawsuit is "frivolous" and that it would defend the right of video game developers to share their works-in-progress without fearing that they'll be targeted with lawsuits over discrepancies between the demo edition and the final version.
