Lawyer is trying to convince judge to give star a break after jail

Though sentenced to 90 days behind bars, Lindsay Lohan will most likely be a free woman by the end of this week, less than two weeks after turning herself in to begin serving her sentence. However, she will still have to check in a rehab facility in California, where she’s to remain for 3 months, also as per judge’s orders. Not before she gets to spend some time with her family, though, her attorney hopes.

Shawn Chapman Holley is telling People magazine that Lindsay is not in the brightest of spirits right now (which is only understandable, come to think of it), which is why both are hoping the judge will give her a break before sending her to rehab. At the moment, the only thing the legally troubled actress wants to do is to spend some time with her family, which, as fans must know, doesn’t include her lying and despicable father Michael Lohan.

“With less than a week left in jail, Lindsay Lohan is now thinking – and worrying – about what comes next: her mandatory three months in rehab. ‘She’s a little upset right now,’ her attorney Shawn Chapman Holley said after visiting the actress Tuesday. ‘She’d like to spend some time with her family, and there’s at least some question as to whether or not she’ll have to go directly to rehab’,” People writes after speaking to the actress’ legal representative.

“Prosecutors confirmed Tuesday that Lohan must report to an LA-based residential rehab facility 24 hours after her release from jail, which likely will be Sunday or Monday, but her attorney is concerned ‘there’s a push now for her to go directly to rehab from jail. I think it would only be fair for her to spend some time with her family and that’s what she’d like for me to emphasize to the judge,’ says Holley,” the publication further notes. However, the judge previously said that Lindsay would not be getting preferential treatment, so perhaps leniency is not what Holley should ask for with her client.

Lindsay Lohan was found guilty of driving under the influence on two separate occasions in 2007 (on one of them, she also had cocaine in her possession, so that’s an extra charge for her). She was put on probation but she recently violate the terms of the probation, which is why she’s now in a women’s prison in Lynwood, California. Reportedly, ever since she was incarcerated, Lindsay has not ceased to cry her eyes out.
