By discrediting police officers responsible for the leaks in the case

Mark Geragos, Chris Brown’s high-power attorney, is certain he can have the assault and making terrorist threats case against his client dismissed at the first hearing, as TMZ confirms. Apparently, the attorney is trying to pull the names of all the LAPD officers who had contact with the media and leaked details pertaining to the case to the newspapers and tabloids, and then use this info to discredit him and have the charges dropped.

Furthermore, the attorney could actually have reason good enough to convince the judge that the cops who testify on behalf of Rihanna (that is, speaking of the injuries she sustained during the February 8 altercation) are lacking credibility for compromising the investigation. What Geragos is actually referring to is the leaked photo of a bruised Rihanna that, according to him, was sold to TMZ by a cop who was directly involved in the case.

“Geragos believes the photo was leaked by an LAPD officer – He writes, ‘...this highly prejudicial photograph was sold by an LAPD officer to the entertainment website, Thirty Mile Zone (TMZ). The photograph was immediately viewed by hundreds of thousands of viewers and was plastered on every news channel for the following weeks’.” TMZ says, citing from court papers just filed.

Consequently, “Geragos wants notes from the Internal Affairs investigation, along with police officer notes and other documents, stating, ‘I intend to use such evidence at the preliminary hearing to attack their credibility. The defense intends to prove and argue that the afore-mentioned officers are not credible and that the Court should not believe some of their statements.’ Geragos adds, if the court has questions about the credibility of officers in the case, ‘I believe there is a reasonable likelihood that the case will be dismissed at the preliminary hearing’.” as TMZ further explains.

This is not the first time that Brown’s attorney is saying there’s a chance of having the case dismissed because of the leaks to the media that occurred while the investigation was still ongoing. Whether he will actually succeed in making a judge see things similarly is yet to be established, so keep an eye on this space for more.
