The Korean company wants to pay a smaller amount instead

It looks like the never-ending legal battle between Apple and Samsung is far from over as the South Korean stated last week that it refuses to honor the amount of money for infringing Apple's iPhone design patents.

On May 24, 2018, after more than seven years and three retrials, a jury ordered Samsung, a South Korean multinational electronics company, to pay the sum of $533,316,606 USD for the three design patents and another $5,325,050 USD for other two iPhone design elements Apple claimed it stole from them.

Intially, Apple wanted Samsung to pay $1B in damages for patent infringement, but Samsung said it should pay only $28 million. Finally, Apple win the legal battle last month, but now Samsung refuses to pay the amount of money ordered by the jury, asking the court on Thursday for a retrial, according to Law360.

Samsung asks the court for a fourth retrial

Not only that Samsung refused to pay Apple the amount of money it owns for iPhone design patent infringement, but it would appear that the South Korean electronics company submitted a post-trial motion for a fourth retrial while also asking the court to reimburse it $145M for damages, which Samsung paid to Apple for a wrong touch-screen patent.

"The jury’s verdict is excessive and against the weight of the evidence on each and every issue identified above, and … the evidence supports a verdict of no more than $28.085 million," the motion said, which was scheduled for hearing on July 26, 2018. Meanwhile, Apple has until June 21 to respond to the motion.

The motion submitted by Samsung's lawyers on Thursday, June 7, 2018, appears to repeat the same things they made in court last month when the jury gave the verdict, namely that the "article of manufacture" found to infringe Apple’s iPhone design patents should've been for specific components instead of the entire phone.
