Google and Huawei are currently the targets of a class-action suit regarding bootloop and battery drain issues experienced by some Nexus 6P owners. The device that was released in September 2015 was actually developed by Google and manufactured by Chinese smartphone maker Huawei.

The lawsuit claims that Nexus 6P smartphones are defective because “they are prone to enter an endless bootloop cycle which renders them unresponsive and unusable.” In addition, they allegedly suffer from a “Battery Drain Defect” reported by other Nexus 6P users.

According to the suit, Nexus 6P’s problems were experienced by users before and after the warranty period, while manufacturers sometimes don’t honor warranty. In cases when the warranty is honored “consumers have had to wait several days or weeks to receive an accommodation, which often ends up being a refurbished Phone that suffers from the same Defect.”

Google and Huawei are accused of breach of warranty and fraud

A trial date for the lawsuit hasn’t been set yet, but the Northern California federal lawsuit claims breach of warranty, fraud, unjust enrichment and violations of a number of federal and state consumer laws. The amount of compensation wasn’t specified, but damages are sought to compensate consumers that purchased the Nexus 6P for prices varying between $499 and $649.

Google and Huawei have yet to publicly acknowledge the bootloop and battery defect that affect Nexus 6P smartphones, and the lawsuit claims that the two companies have no intention of fixing the problem, since they declined to repair affected units numerous times.

Smartphone makers are constantly hit with class-action lawsuits from disgruntled customers. In a similar lawsuit, some owners of V10 and G4 smartphones sued LG and requested that the company start a program to repair phones affected by a bootloop issue.

LG’s strategy was to acknowledge the issue when it occurred and replace faulty units. But customers are now displeased because LG continued to manufacture phones with the bootloop defect.
