The company would like to get them back for commercial reasons

Assets that belonged to the now dead 38 Studios development team will be soon auctioned off, and among the items that are looking for new homes potential buyers can find a number of Xbox 360 development kits.

They might be ready for auction, but Microsoft says that the devices are actually company property and cannot be sold.

A statement from Microsoft reads, “Xbox 360 Development Kits (XDK) are the property of Microsoft and are only licensed to authorized studios and may not be assigned or sold to any third party without the written consent of Microsoft.”

It adds, “We will be contacting the appropriate parties involved in the auction of 38 Studios’ assets to remove the XDK units from the auction listing and to secure the return of the consoles to Microsoft.”

38 Studios imploded earlier during the year after disappointing sales of their first launch Kingdoms of Amalur: Reckoning.
