Communication break-down

As we informed you two days ago, Claire Barnes, a 48-year-old woman from Oregon decided to sue Yahoo, because the company's officials did not delete from the portal a series of nude images depicting her, posted by her ex-boyfriend.

The problem is that, according to American legislation, Yahoo cannot be held responsible for the content posted online by third parties, so that the legal action actually targets Mary Osako, Yahoo's communication director.

Claire Barnes claims that after numerous e-mails sent to Yahoo, Mary Osako had allegedly made her a verbal promise that the images will be deleted from the Yahoo portal and services.

Considering that this conversation took place at the end of March, and Barnes still found her nude pictures online, she decided to act by means the legal system.

In any case, Yahoo cannot be held responsible for the fact that those images were posted online, Claire Barnes' only chance being to prove that, once notified, the company failed to take the appropriate measures in order to delete the photographs in question.

However, the case is appraised to be quite complicated, a verbal promise being in question. It remains to be seen who wins this case or if a settlement will be reached.
