Apple can still try to prove the tablet infringes its patent though

Samsung has scored a small victory in its continued patent war with Apple: the preliminary injunction against the Galaxy Tab 10.1 has been lifted in the US.

The injunction was issued by a different court than the one in San Jose, California, which has been overseeing the proceedings of the trial under a jury.

Samsung tried and failed to persuade Judge Lucy Koh to lift this ban last month, but she did not do so, citing lack of jurisdiction.

Apple still has a chance to convince the court that the Tab 10.1 infringes its D'889 patent, but until it gets the chance, Samsung will feel vindicated, if not satisfied.

What we're more interested in is if anything will come of Samsung's other hope, the one where it wishes it could reset the whole patent war on the grounds of jury misconduct.
