The comedian's lawyer confirms that his recovery is still a constant battle

It's been two months since Tracy Morgan was involved in a serious car crash that left him and several of his friends in a serious condition while another was killed. The limousine he was traveling in was hit by a truck and the actor was put into the hospital with cracked ribs and a badly broken leg.

Now, the NY Daily News has the first reports on his health, after months of speculation. Immediately after the accident, there were rumors that Tracy had died or that he had to have his leg amputated. Tracy's lawyer, Benedict Morelli, claims that those reports are untrue, but that Tracy's recovery is a long and hard process.

After nearly two months since the accident, Morelli claims that Morgan is still “struggling” to recover fully. “The truth is that he's struggling, but he's fighting hard.” His fight is made harder by the fact that the actor is still mourning the loss of his friend James (Jimmy Mack) McNair in the same accident that put him in the hospital.

Morelli went on to reveal that “He's got the fighting spirit, but every day is different. Some days he's very down.” When paparazzi caught up with the comedian last month outside his home in Cresskill, New Jersey, he appeared to be in good spirits as he flashed a big smile and the peace sign, while walking to his car with the aid of a walker.

The lawyer was careful to add that at this point in the recovery, “It's not only physical, it's emotional.” He also added that “Now, there's been a couple of people who said he's doing great. And that's not true. What is true is he's struggling and he's fighting.”

The crash also involved other passengers in the car at the time: Morgan's longtime friend and mentor James (Jimmy Mack) McNair, his assistant Jeffrey Millea, and comedian Ardie Fuqua. All were injured in the crash while McNair died in the crash.

The driver of the truck, Kevin Roper, pleaded not guilty to charges of vehicular manslaughter and assault by auto in connection with the accident, which he called “a terrible tragedy,” but vowed to cooperate with the police in the still ongoing investigations.

He was driving a truck for Wal-Mart at the time of the crash, and the retail giant has issued a statement claiming that it would take “full responsibility” if the driver of the truck was found guilty of the crash. Since the accident, Morgan and the other passengers of the car have filed a lawsuit against Wal-Mart.
