
'Rock Star: Supernova', the CBS/Burnett television show, has been constantly pledged by conflict. More recently, a band from Orange County, bearing the same name as the reality series is taking legal action against the three rockers, Tommy Lee, Jason Newsted and Gilby Clarke, and against the studio for copyright infringement.
Basically, Supernova, founded in 1989 and probably best known for the song 'Chewbacca' from the 'Clerks' soundtrack, is trying to stop them from using the name for any further music records or any other materials. 'Rock Star: Supernova' centers on the three rockers in their quest to find a proper frontman for the new band which, up to this point, was supposed to be called Supernova as well.
Until this moment, the two parties, the lawyers from Supernova and those from CBS, were in talks for a settlement but things got out of hand and matters were taken to court. 'Our client has taken legal action in order to preserve its rights to the name the band has worked so long and hard to establish. We tried to settle the matter quickly and fairly, but after lengthy negotiations with CBS, Mark Burnett Prods. and others, they left us with no options but to seek the preliminary injunction', a representative of the band announced today.
The original band, which already has three fairly good selling albums on the market and another one in the making, is seeking a court hearing within 28 days. But the other side is just as determined to have a judge rule in their favor. The litigation and intellectual property counsel for Burnett Productions insists that they haven't been served with a legal complaint and that, either way, they have the legal right to use the Supernova name, as the punk band hasn't performed since the '90s so there is no risk of mistaking the two bands.
