An eighth-grader from West Virginia has been detained and placed in jail over his refusal to change his T-shirt.

The item of clothing, which is pictured above, features the image of a gun and a message about protecting your rights, as well as mentioning the NRA.

According to the Examiner, Jared Marcum claims that the arrest is a violation of his rights and freedom of speech, citing the Second Amendment.

Marcum's teacher at Logan Middle School called the police on grounds of the student interrupting class and being disruptive.

He has been charged with "obstruction and disturbing the education process for refusing to change the shirt."

As a result, the student was suspended, prompting an immediate response from his classmates who showed up to school in similar shirts in a bid to lobby for his release.
