The plaintiff didn't include the product she actually purchased in the complaint

Kathleen Haskins filed a class action lawsuit against IT security firm Symantec arguing that the company didn’t properly protect its customers against cybercriminals, because the source code of several products was stolen back in 2006.

According to Law360 (registration required), Haskins stated that Symantec didn’t say anything about the source code theft until 2012, when Anonymous hackers leaked it online.

She claims that the product she had purchased from the security firm didn’t protect her properly because its source code had been available to cybercriminals.

However, US District Judge Jon Tigar dismissed the case because the complaint filed by Haskins mentions only pcAnywhere, Norton SystemWorks, Norton Antivirus Corporate Edition, and Norton Internet Security. It doesn’t contain Norton Antivirus, the product she had actually purchased.

Judge Tigar has allowed the plaintiff to file a second amended complaint if she can come up with other facts that overcome the issues mentioned in the dismissal order.
