South Korean mobile phone maker Samsung and wireless carrier T-Mobile USA reportedly face class action lawsuit, because they failed to deliver an OS upgrade for the Samsung Vibrant (a Galaxy S device) in the US.

Although it is one of the most popular Android-based mobile phones of the last year, the Samsung Galaxy S still hasn't received the Android 2.2 Froyo update in all markets around the world.

To add fuel to the fire, some of the latest reports around the Internet suggested that the two companies were actually holding back the software update.

Apparently, the two would plan launching a new Galaxy S device, the Vibrant 4G, and they would be delaying the OS upgrade for the current handset on purpose.

Users already expressed their disappointment with the delay in releasing the software update, and it might all end up in a class action lawsuit, in the event that Samsung and T-Mobile do not release the upgrade in due time.

Here's what a user states on the XDA-Developers forum (via Android Community):

They have continuously lied to us about the hardware, 
and software reliability of this phone, 
they promised us updates (to 2.2! Not the functionally dead JI6 2.1!) 
over and over, 
NOW they plan to release NEW galaxies 
without updating the old ones they currently have

The GPS is clearly a hardware defect. 
There are just too many issues with this phone
and the Customer service reps have been combative
even bullying and threatening customers!

The Android 2.2 Froyo update for Galaxy S devices started to roll-out to unlocked handsets several months ago, and various carriers around the world already delivered it to their users.

However, there still are Galaxy S devices which did not taste Froyo as of yet, and those on the US market are among them.

It does not come too much as a surprise that users are angry, although Samsung said not too long ago that the update would be coming soon, not to mention that the possible launch of Vibrant 4G is only a rumor at the moment.
