Australian news outlets are reporting that Samsung is not backing off in its legal spat with Apple and, in fact, is pushing forward with plans to have the Cupertino company’s iPhone 4S banned down under.

Specifically, Samsung counsel Cynthia Cochrane is asking Judge Annabel Bennett to force Apple to hand over the source code for the iPhone 4S firmware, as well as Apple's agreements with all major Australian operators, in order to build a case.

Apple continues to uphold that the family-owned South Korean company infringes on iPhone and iPad patents. The Cupertino, California computer vendor has already managed to temporarily ban sales of Galaxy Tab 10.1 in Australia, while under the leadership of the late Steve Jobs.

Samsung is seeking to ban the sale of iPhone 4S claiming the device is in violation of not one, but three wireless 3G patents owned by the Korean company.
