
Actor Joe Pesci was about to face a criminal charge for giving a fan a fat lip after the man had put his arm around him and took a picture without permission outside a Boca Raton strip mall.
Prosecutors in Florida decided there was not enough evidence for action against the actor because police were unable to decide who was "the primary aggressor" and had no witnesses to the alleged incident.
It was Juan Montenegro, age 24, of Fort Lauderdale, who accused the Oscar-winning actor of slugging him in the face as he tried to get a picture on Jan. 22.
Pesci claimed that he tried swatting away the camera and hit the student's face after Montenegro put his arm around the actor's neck and shoulders in a pose for a picture, the South Florida Sun-Sentinel says. Pesci also declared he stopped next to a police car at the strip mall to report the incident, but couldn't find an officer in the area and left.
Pesci is best known for his parts in films like "My Cousin Vinny" and "Goodfellas."
