John Van Allen II had a criminal record, he was getting out of his marriage

A former soldier killed during a highway shootout in Oregon two months ago had his three children in the car with him, reports say.

34-year-old John Van Allen II refused to get back in the car when an officer pulled him over for speeding. He was dressed in military gear and drew his weapon, shooting the deputy.

He was shot back and fled in his vehicle. New York Daily News informed that Van Allen's three kids, a 10-year-old girl and two boys, ages 13 and 15, were also in the vehicle.

They have not been injured, but Van Allen was killed by a single bullet to the chest. He had moved from Pittsburgh to Portland last year, after a divorce.

He also had prior arrests for brawling and traffic violations. The children are now in the custody of the Department of Human Services.
