
When Nicole Richie was busted for driving under the influence a couple of days ago, she confessed that she had taken Vicodin and smoked pot a few hours prior to driving against traffic on the freeway. She was taken to the police station and was released later on bail.
The next day, Nicole admitted, via a statement from her publicist, that she was wrong in getting behind the wheel that night and 'assumed her responsibility' for the arrest. The only thing that still remained to be seen was which charges the police would file against her, pending the blood alcohol tests.
After several days of digging through police papers, TMZ (the same news agency that also broke the story of the bust) has uncovered documents that prove this is not Nicole's first instance of driving under the influence. She was also arrested in 2002, when she pleaded no contest.
According to California law, if Richie is found guilty of DUI this time, the judge that will rule in the case will have to sentence her to five consecutive days in a county jail, plus one year and a half in a rehabilitation program and community service hours. The law applies to any two-time DUI felon, no matter if s/he was drunk at the time or not.
In addition to that, Nicole is trying to somehow clean her name of the pill-popping accusation, claiming that she is not addicted to Vicodin. She only takes the pill once in a while, to alleviate her severe menstrual cramps, 'Us Weekly' reports. Yeah, and the marijuana she smoked that same night must have been for medicinal use, too - to treat her aching back, or something.
