Jordan Linn Graham will be in court on December 9

The legal defense team of a woman accused of killing her husband by pushing him off a cliff in Montana are arguing for the prosecution to drop a new theory that could make or break the case.

Prosecutors will be trying to prove that the Glacier National Park murder has been planned in advance, Fox News writes.

They allege that newlywed Jordan Graham, 22, only pushed off her husband, Cody Lee Johnson, after blindfolding him.

That would prove that Graham has had a prior intent when hiking with her groom on the Loop Trail.

She originally stated that she knew nothing of his whereabouts, but she went on to admit that she had cut his life short during a quarrel.

Officials have found textile evidence below the trail, where the victim’s body was found. They are conducting DNA testing to prove the theory. However, the defense has filed a motion to have it excluded.

Attorney Michael Donahoe argues that he has only been informed a month ago about the new direction that the prosecution will be pursuing, with the trial starting on December 9.
