Mischa Barton Won't Go to Jail

- The O.C. actress pleaded no contest to DUI and was cut a deal that doesn't require her to do any jail time at all

Celebrity justice strikes again. This time, the lucky offender who gets to walk away without doing any time and without trying on the famed orange jumpsuit is neither Nicole Richie, nor Lindsay Lohan, but the former O.C. alumn Mischa Barton. The actress was arrested in L.A. last December for driving under the influence of alcohol, possession of marijuana as
well as another controlled substance and driving without a license. However, if you expected Mischa to camp out in the same cell as Paris Hilton once did, you were terribly wrong, as it was announced earlier today that the actress and socialite accepted a plea deal in the DUI case, one which allows her not to be locked up behind bars for a while.


It was announced that Barton will plead no contest to DUI at her arraignment, which will take place Thursday in Beverly Hills court. She will also reportedly agree to serve a three-year unsupervised probation term. Barton will apparently also be sentenced to complete a three-month alcohol-education class, and pay a very heavy fine of around $1,700. As a result, the marijuana possession charge against the actress will be dropped, apparently because the arresting officers found her to be carrying a very small amount of the recreational drug. Also, a source added that the charge of driving without a license will be reduced to an infraction. No word yet on the other "controlled substance" found in Barton's possession. A spokeswoman for the Los Angeles District Attorney's Office would not comment on the case.


This effectively means that Mischa will walk free after her arrest, which occurred when sheriff deputies reportedly spotted her car weaving between two traffic lanes, and failing to signal when making a turn. At the time, Barton - who was bailed out of jail by her parents - accepted responsibility for her reckless behavior. "Obviously I'm 100 percent responsible for my actions in this case," she stated on Ryan Seacrest's L.A. radio show at the beginning of January this year. "I'm really disappointed in myself. I don't know what to say about it, except that I'm not perfect, and I just don't ever intend to do something this stupid again." The plea was negotiated by Barton's lawyer and will reportedly be signed off on by the court Thursday in two days' time.
