In Chicago, a man who had bought the new Xbox 360 gaming console sued Microsoft on the basis that the new gaming console has a design error that lead to its overheating.

Robert Byers claims that Microsoft rushed to enter the first in the third generation video game consoles market,
that has a 25 billion USD value, before competitors like Sony and Nintendo, launching a faulty designed product.

The man says that Xbox 360's power source and the central processing unit (CPU) overheat, affecting other heat sensitive chips and the console freezes. Also, right after Xbox 360's 22 November launch in USA, many dedicated sites and forums received complains form users.

The users said that the system crashed during its use, and showed black screens and error messages. Microsoft Officials stated at the time that only a few isolated incidents were reported, but did not say the number of the received reports. Anyway, they said that the number of complains is very small in comparison to the number of sold consoles.

The intended lawsuit was filed in Illinois and asks for the replacement of the faulty Microsoft Xbox 360 consoles and litigation related expenses.
