The XBOX manufacturer wrongfully seeking to terminate $ 2 million deal

French developer In-Fusio has decided to sue Microsoft claiming that the latter is wrongfully seeking to terminate a mobile gaming deal worth $2 million. According to In-Fusio, Microsoft has refused to approve any of the game designs during the 11 months since the agreement was signed. After mobile-phone game developer In-Fusio announced a deal to bring Halo content, such as wallpapers or ringtones to mobile phones, service being described in the suit as being merely a prelude to the development of a mobile phone version of the Game Halo, the French company failed to make the second of four $500,000 payments required under the deal.

Microsoft cited this lack of payment as justification for ending the agreement, while In-Fusio sustains that it hasn't made the payments because Microsoft has not lived up to the obligations in the agreement. "Under the agreement, In-Fusio's Halo programming designs are subject to Microsoft's approval, which cannot be unreasonably withheld," the suit says.

It adds: "Microsoft has thwarted In-Fusio's efforts to develop Halo under the agreement. Indeed, in the last 11 months, Microsoft has approved no fully developed In-Fusio Halo game designs; ignoring and then refusing to accept In-Fusio's game design concepts with little or no explanation and leaving In-Fusio little basis to revise its concepts to obtain Microsoft's approval." In-Fusio is requesting damages and an injunction on Microsoft.
