Judge rules the Applebee's restaurant where the incident occurred is not to blame, decides to dismiss the man's lawsuit

Quite a while back, in March 2010, a US man by the name of Hiram Jimenez burned himself pretty badly when he bowed his head to pray over sizzling steak fajitas. The incident occurred at an Applebee's restaurant in New Jersey's Burlington County.

Rather than admit that this incident was his own doing and, as Queen Elsa would phrase it, let it go, the man decided to blame Applebee's for his injuries. He even went as far as to seek legal counsel and move to file a lawsuit against the restaurant chain.

Unfortunately for Hiram Jimenez, things did not exactly work out his way. Just yesterday, it was revealed that, after having listened to his complaints against the New Jersey Applebee's Neighborhood Grill and Bar restaurant, a judge moved to dismiss the lawsuit.

To add insult to injury, this judge was not even the first to rule in favor of the restaurant chain. On the contrary, yesterday's ruling came from a New Jersey court of appeal and merely upheld another judge's decision not to let the man sue Applebee's, the Courier Post informs.

How the man burned his face while deep in prayer

As mentioned, it was in March 2010 that Hiram Jimenez visited an Applebee's restaurant in Burlington County, New Jersey, and ordered himself a steak fajitas. After the dish was brought to his table, the man bowed his head to pray before eating it.

The man says that, almost immediately after he lowered his head, he heard a loud sizzle accompanied by a grease pop. Moments later, he realized that he had burned his face and his left eye. He panicked, knocked over his plate and ended up suffering plenty of other burns.

The man insists that staff at the Applebee's Neighborhood Grill and Bar restaurant should have told him that the dish was insanely hot and that it was only because of their negligence that he burned himself as badly as he did. Hence his attempt to sue the restaurant chain for compensation.

However, the judges who have until now had the chance to hear his story all agree that, since it was sizzling when it was brought to him, the steak fajitas dish was clearly and without a doubt dangerous. Otherwise put, the man has nobody but himself to blame for his injuries.
