Lindsay Lohan Goes to Jail Again, Is Out on Bail in Hours

Last weekend, it emerged that Lindsay Lohan had failed two court-mandated drug tests and was liable to go back to jail for violating her parole. She just did that – and was then immediately let out.

As part of a sentence from a 2007 DUI arrest, the actress went to prison and rehab and was then put on probation. All throughout probation, she was to submit to random drug tests, which she should have passed with flying colors – and didn’t.

Yesterday, Lindsay was in court again, where she was sentenced to 30 days at the Lynwood correctional facility for violating her parole, People magazine reports.

She was refused bail and was put in a VIP cell (if you will) because she couldn’t be put in gen pop given her celebrity status.

She was also denied bail, which meant she was to spend the following 30 days in prison. Her attorney appealed the sentence and another judge stepped in on the case, TMZ informs.

Bail for Lohan was set at $300,000, she made it and was let go. Officially, the actress is a free woman again but, as the aforementioned media outlet puts it, her freedom does come at a price.

In other words, a new set of conditions has been drawn up to her – should she be caught on the wrong side of the law again by violating the new rules, she goes back to the slammer.

“Lindsay will have to get a SCRAM bracelet (this will be her third) within 24 hours – and under the terms of her bail, she is not allowed to be around known drug users,” TMZ says.

“[She] must submit to search by law enforcement at any time. Also, nightclubs will be a major no-no... Linds has to stay out of places where alcohol is the ‘chief item of sale’,” the same media outlet says.

What got Lindsay out of prison this time was her attorney’s plea that she’d been unlawfully detained by having her bail denied.

“An order has been signed by Judge Patricia Schnegg granting writ of habeas corpus,” court spokesman Allan Parachini told People magazine hours ago. “Bail has been set at $300,000,” he mentioned.

“Habeas corpus refers to the release of an inmate due to unlawful detention. Schnegg, an assistant supervising judge of the criminal courts, cited state law that guarantees the right to bail in misdemeanor cases,” the magazine explains.
