The legal teams can still agree on a plea bargain later on

Last week, I documented the ongoing trial preparations in the case of Aurora shooter James Holmes. DA George Brauchler has announced on Monday, April 1, that the State is going after the death penalty for Holmes.

As I informed you, he went on a shooting spree last summer, taking 12 lives and injuring 58 people in a movie theater as "The Dark Knight Rises" was being screened.

"For James Eagan Holmes, justice is death," Brauchler says.

Previous reports revealed that the defense had offered a guilty plea that would have granted the killer life in prison without the possibility of parole.

According to The Christian Science Monitor, that does not ensure that the prosecution is in for a conviction, as the jury could decide that Holmes is not liable for his actions on grounds of insanity.

Attorney Daniel Recht of Denver weighs in on the case, mentioning that a plea bargain can still be reached throughout the trial.

There is no confirmation at this point that Holmes' lawyers will be going for the insanity strategy, but there are no doubts on Holmes being the shooter in this case so there are not a lot of avenues to address his defense.
