Thanksgiving ended on a very sour note for Gabriel Aubry and his ex, Halle Berry, as he got into a fight with her current fiancé after dropping their daughter Nahla off. Now, Berry is trying to convince a judge to grant her a permanent restraining order against Aubry.

Gabriel and Halle broke up some time ago but, ever since, they have been locked in a very bitter custody battle, with the actress even petitioning to be allowed to move to France permanently, together with her fiancé Olivier Martinez.

On Thanksgiving, after dropping Nahla off, Gabriel and Olivier got into a very violent brawl that ended with Gabriel in police custody and in the hospital.

Olivier is looking to press battery charges, but Halle too is using this opportunity to finally block her ex out of their daughter’s life, TMZ has learned.

“Sources familiar with the situation tell TMZ Halle and her lawyers are alarmed that Gabriel allegedly started the fight with Olivier Martinez right in front of 4-year-old Nahla. Although a judge issued an emergency order of protection – requiring Gabriel to stay 100 yards away from Halle, Nahla and Olivier – that order expires Tuesday,” the celebrity e-zine reports.

This week, Berry and her attorneys will be in court to ask for the order to be extended for “an indefinite period of time.”

“Sources tell us, Halle's argument is pretty simple – if Gabriel can't control himself enough to protect Nahla from emotional trauma, it's too risky for him to be around the child, Halle, or her fiancé, with whom he clearly has beef,” TMZ writes.

Furthermore, this recent incident will only prove what Halle has been saying in court ever since the custody battle began, namely that Gabriel’s temper is highly flammable, which makes him a very unsuitable parent.

As we also noted at the time based on online reports, Gabriel reportedly threw the first punch after Olivier heckled him in French. Afterwards, Martinez immobilized him and made a citizen’s arrest, waiting until the police arrived to hand him over.
