The legal battle between them has been dragging since 2008

Epic Games has managed to win yet another legal fight with Silicon Knights in a drawn out legal process that is centered on the Unreal Engine and the failure of Too Human.

The United States Court of Appeals says that Silicon Knights has failed to bring new arguments to the table in order to show that its position should be taken into account and still needs to pay significant damages and legal costs.

In 2008, the company launched Too Human, a game that failed to impress critics or the public, and then sued Epic Games claiming that it failed to offer a fully functioning version of the Unreal engine tech and never provided appropriate support.

The court battle has dragged on ever since and it is unclear whether Silicon Knights currently has the resources required to pay damages.

Its founder, Dennis Dyack, is at the moment working with Precursor Games and has failed to secure funding for his first new project since Too Human.

The game was first posted on the Kickstarter crowdfunding site, but did not reach its total in the allotted period.

Precursor Games is still accepting support from interested fans, but it is currently unclear whether it can get the resources it needs to actually create Shadow of the Eternals.

At the moment, Epic Games is putting the finishing touches on Unreal Engine 4, which is designed to take advantage of the extra hardware power of the PlayStation 4 and the Xbox One, while also keeping up with advances in PC-based tech.

The company is also developing a game called Fortnite, which is designed to show off the best elements of the new engine.

Fans have speculated that Epic Games might abandon game developers in order to focus on the creation of middleware in the coming years.
