She is trying to prove he cheated on her, wants the case to go to trial

Yesterday, word got out that Demi Moore was getting ready to file divorce papers, in response to Ashton’s December filing. She’s done just that, various reports confirm, noting that Demi is asking for spousal support.

Radar Online has obtained the court documents and, after a careful look, it concludes that Demi wants the case to go to trial as she believes she stands a good chance of winning because she can prove Ashton cheated on her.

“Demi, 50, wants Ashton, 35, to pay. She is seeking spousal support from the super rich actor and wants Kutcher to pay her legal bills. She cited irreconcilable differences as the reason for the breakup,” Radar writes.

According to the tab, Demi is convinced a judge would see things her way and grant her request or, at least, that’s what the filing seems to indicate.

“Moore cites the date of separation as November 17, 2011. That’s crucial because Ashton hooked up with Sara Leal in San Diego on September 24, 2011 — with Leal claiming that he said he was separated,” Radar writes.

Demi and Ashton’s marriage came crumbling down when it was confirmed that he spent their 6th anniversary partying and sleeping with Leal, while Demi was on the road promoting a new film.

This was the second scandal of the kind the couple faced in as many years and, as it turned out, one that Demi was no longer willing to forgive.

Repped by high-powered celebrity attorneys Laura Wasser (Ashton) and William Beslow (Demi), the two stars are en route to a court trial, reports online indicate.

For months, they have been trying to come to a favorable financial agreement but they are now reportedly reconciled with the idea that it’s not possible.

Moreover, word has it, Demi is determined to make Ashton pay through his nose for the heartbreak he put her through.
