
Earl Simmons, a.k.a. DMX, who has faced a 60-day term and a $1,000 fine after pleading guilty last month to violating the conditions of his release following a June 2004 incident at Kennedy International Airport, was slapped with an extra 10 days behind bars on November 18, for disrespecting the court, a Queens, N.Y. judge decided.
The famous rapper, who pretended he was a federal agent, has smashed his SUV into a parking lot gate to apparently avoid paying the $9 parking charge.
DMX came almost three hours late for sentencing, so judge Chin Brandt had issued a bench warrant for his arrest and threatened to impose a one-year term.
Simmons apologized for being late and said he had an asthma attack, providing the court with a doctor's note verifying his illness.
"I'm still a person with kids at home and a wife. I am sorry. I was sick. I apologize", the rapper said.
"I'm not happy with the 10 days, but it's better than a year", stated Simmons' attorney, Murray Richman.
The new 70-days sentence imposed to the 34-year-old rapper, who appeared in court with his hands cuffed behind his back after spending the night in jail and was immediately taken to Rikers Island, could be reduced to 46-days, for good behavior.
DMX will spend Thanksgiving and Christmas behind bars.
