Xbox 360 "crash," "freeze" or "lock up" - the usual stuff

According to this piece up on Courthouse News Service, California resident Randy Nunez has filed a class action lawsuit against Bungie and Microsoft "requesting (unspecified?) damages" (according to Kotaku.com), for when he popped in the Halo 3 game disc, his Xbox 360 began to "crash," "freeze" or "lock up." Here's his argument below:

"Halo 3 does not function with the Xbox 360, and to the contrary, attempted use of Halo 3 consistently causes the Xbox 360 to "crash," "freeze" or "lock up" while the game is being played."

An excerpt from the original piece says: "Microsoft's highly touted "Halo 3" video game, made exclusively for its Xbox 360, causes the Xbox to freeze or crash, ruining the game, according to a federal class-action complaint. ... Lead plaintiff Randy Nunez says he paid $59.99 for his game. He wants class certification and damages. He is represented by Bonnett, Fairbourn, Friedman & Balint of Phoenix and San Diego. See complaint."

Now, does this strike anyone as awed, or overreacted behavior to say the least? Don't get me wrong Nunez but just as everyone knows what a Halo 3 copy goes for around 60 bucks, everyone also knows that the Xbox 360 is a rather faulty machine that freezes, crashes and ultimately shows those annoying red flashing lights when it's stepping 'into the light.' But suing not one company, but two companies for the game not working...?

I might have missed something within this story, but I didn't see anything about other games freezing besides Halo 3 in this guy's case, so I wonder why he didn't just call Bungie customer support, instead of making such a big fuss about it. Had Nunez sued just MS, I'd have agreed with him here, since the Xbox 360 is known for all its issues. However given that the errors occurred only while playing Halo 3...

Eh... whatever the reason, I sincerely hope that Randy Nunez gets acquitted, while Microsoft and Bungie get on top of this issue, should it become a widespread one. Not taking any sides here because I myself know how frustrating it can be to get your favourite game, pop it in the disc drive to see it malfunctioning or not working at all.
