Tara Costa got her shot at a healthier life thanks to NBC’s hit reality series Biggest Loser, where she lost 155 pounds (70.3 kg) through a healthy diet and rigorous exercises. Now, a fitness company is suing her for unspecified damages for allegedly gaining too much weight to be able to represent them.

Costa is now studying PE and has started her own charity. She’s also signed various endorsement deals, one of which with FC Online Marketing, Inc., which is now suing her, as The Wrap has learned.

“Among the gripes in the lawsuit, filed in U.S. District Court in Florida: That Costa ‘had gained far too much weight’ to make personal appearances on behalf of the company,” the publication reports.

“FC Online Marketing, Inc. – which owns the website I Love Kickboxing – claims that the alleged weight gain ran contrary to a passage in the agreement that Costa ‘agrees to maintain her current level of fitness and conditioning’ during the length of the agreement,” The Wrap further says.

The Inspire Change Foundation, which Costa started, is also named in the suit, which includes more claims than just the one mentioned above.

“The complaint also claims that FC Online Marketing agreed to pay the Foundation $45,000 [€34,956] for ‘likeness rights’ to Costa – rights that, the suit alleges, were not the Foundation's to grant,” the aforementioned media outlet says.

“On top of everything else, the suit claims, Costa entered into an agreement with one of FC Online Marketing's competitors, in violation of the original agreement,” adds the report.

The fitness company is asking for unspecified damages because of them, citing loss of profit as a result of Costa’s actions.

The Wrap tried to contact Costa or her people for comment on the allegations made in the suit. Neither was immediately available.
