Samsung wants a new trial to take place, with a reasonable jury

Even as Samsung is preparing to begin a new legal battle with Apple, the latter is moving for an increase of the money that the former is supposed to pay it, following the verdict given by the jury in the San Hose, California district court.

For those that haven't heard all that has happened, Samsung already has what it needs to begin a lawsuit against Apple's iPhone 5. The LTE technology in the phone is allegedly infringing on its patents.

After the nearly total defeat suffered in the last round of the patent war, the corporation is more than eager to lash back, even if the trial phase will only be reached in March 2014. But we digress.

What we are here to talk about is not anything Samsung started, but a new, 43-page motion that Apple filed.

Long story short, the Cupertino-based IT player wants $707 million, with roughly corresponds to 545 million Euro, added to the $1.05 billion / 810 million Euro that Samsung already needs to pay.

Furthermore, since the move would not have been bold enough otherwise, Apple also requested a permanent sales ban on 26 Samsung tablets and smartphones.

Meanwhile, since it can't actually get the damage payment decision listed at this point, Samsung has repeatedly argued for a reduction, on the grounds that the jury didn't make correct calculations, to put it lightly.

Alas, even if Samsung did win these debates, it would shear just $35 million / 27 million Euro off the fine, not that much in the grand scheme of things.

The company knows this, of course. In fact, a report from The Wall Street Journal says that Samsung wants a completely new trial to take place, as it feels that the jury wasn't a reasonable one this once. The short time given by Judge Lucy Koh for each side to make their case (25 hours) was insufficient as well, the IT player feels.
