While Anna Nicole Smith's long time friend and attorney appeared on Larry King's show saying that he is the real father of the newly born Danilyne Hope, the man who first claimed the paternity of the baby girl is now filing a paternity suit for the former Playmate to comply with.

Larry Birkhead, whom Anna has been seeing a long time ago, said that, according to his calculations, he is the father of the child, a thing that both the mother and the impostor father (Howard K. Stern) are well aware of. And, as he threatened, he is not willing to let go of her without a fight.

Backed up by the power lawyer Debra Opri, Birkhead says that Smith must bring Dannilyne back to California to have her submitted to a paternity test. He also claims that the glamour model is a methadone addict for a long time and that Stern has done his very best to support the addiction. That was the reason for which she went to Bahamas to give birth, as there they do not test newborn babies for drugs, according to the photojournalist.

In an interview with MSNBC, Birkhead made a series of very damaging allegations against the mother of his child, among which the fact that she is leading such a miserable life that literally makes her an unfit parent. And he has proof for all that, the disgruntled man says. He also stated that Stern accepted the child as his own for purely financial reasons and that he (the lawyer) can't possibly be the real father as he had a vasectomy a couple of years ago.

Birkhead's lawyer is very determined to make matters public, if that's what it takes to give her client the legal and physical custody of the child. 'The public will be very surprised when they learn the details of the lifestyle this baby is going to be faced if she remains in the current situation.', Opri said in a press statement.

Camp Anna and Howard have not yet commented on the latest allegations and accusations.
